Welcome to Clinko (operated by DesignUnic). By accessing or using our platform, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the platform.
1. About the Platform
Clinko is a self-service marketing and customer engagement platform that enables registered businesses ("Business Owners") to:
- Create a personalised link-in-bio page (short link / QR code) to share all their links in one place.
- Collect and redirect customer reviews to Google, TripAdvisor, and other platforms.
- Create and manage gamified reward systems (spin wheels, scratch cards, slot machines, etc.) that customers can play after leaving a review.
- Build a customer database with phone numbers and emails collected through the platform.
- Run WhatsApp marketing campaigns to re-engage customers.
- Manage a customer fidelity and retention loop to grow their business.
2. User Accounts
To use Clinko as a Business Owner, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Business Owner Responsibilities
As a Business Owner using this platform, you agree to:
- Provide accurate and truthful business information on your public page.
- Use the platform only for lawful marketing purposes and in compliance with all applicable local and international laws.
- Honour all rewards, prizes, and offers generated through your reward game system. Rewards are your sole responsibility to fulfil.
- Comply with all applicable data protection regulations (including GDPR, where applicable) when collecting and using customer data through the platform.
- Obtain appropriate consent from customers before sending WhatsApp campaigns or marketing messages.
- Not use the platform for spam, fraud, misleading advertising, or any form of abuse.
4. Disclaimer of Liability
Clinko (DesignUnic) shall not be held responsible or liable for:
- Marketing abuse: Any misuse of the marketing tools, including but not limited to spam, unsolicited messages, false advertising, or misleading promotions conducted by Business Owners.
- Reward abuse: Any disputes, failures to honour, or misrepresentation of rewards and prizes offered by Business Owners through the gamified reward system.
- Content accuracy: The accuracy, legality, or appropriateness of any content, links, or information published by Business Owners on their pages.
- Customer disputes: Any disputes between Business Owners and their customers regarding prizes, services, or promotions.
- Third-party services: Any issues arising from third-party integrations, including but not limited to WhatsApp, Google Reviews, or payment processors.
- Data misuse: Any misuse of customer data collected by Business Owners through the platform, including non-compliance with data protection laws.
Clinko is a platform provider only. Each Business Owner independently creates and manages their own page, rewards, campaigns, and customer interactions. We do not endorse, verify, or guarantee any offer, reward, or promotion created by Business Owners.
5. Customer (End-User) Terms
As a customer interacting with a Business Owner's page on Clinko:
- Any prizes, rewards, or offers you receive are provided by the respective Business Owner, not by Clinko or DesignUnic.
- By entering your phone number or email address, you consent to receiving marketing communications from the Business Owner through the platform.
- Reward tickets are valid for the period stated on the ticket and are subject to the Business Owner's conditions.
- Each reward code is single-use and becomes invalid after redemption.
6. Intellectual Property
The Clinko platform, including its design, code, branding, and all related materials, is the intellectual property of DesignUnic. Business Owners retain ownership of their own content (logos, text, images) uploaded to the platform.
7. Subscription & Payments
Certain features of Clinko require an active subscription. Subscription plans, pricing, and features may change at any time. Refund policies, if applicable, will be outlined at the point of purchase.
8. Account Termination
Clinko reserves the right to suspend or terminate any account that violates these terms, engages in abusive behaviour, or uses the platform for unlawful purposes, without prior notice.
9. Limitation of Liability
To the maximum extent permitted by law, Clinko (DesignUnic) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or related to the use of the platform.
10. Privacy
We take privacy seriously. Clinko collects only the minimum data necessary to operate the platform. Business Owners are responsible for their own privacy practices regarding customer data they collect. For more details, refer to our Privacy Policy.
11. Changes to Terms
We may update these Terms & Conditions from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms. We recommend reviewing this page periodically.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DesignUnic operates.
